Who has to apply for Business Registration under the Shop and Establishment Act?

Every owner/employer of the shop & establishment shall apply for registration within 30/60/90 days from date on which the establishment commences its business.

Whether the Registration certificate requires to be renewed if so at what intervals?

Every registration certificate is required to be renewed 30 days prior to the expiry of the term of the Registration Certificate.

What is the procedure for applying for registration & Renewal?

One needs to apply for Business Registration License within the stipulated period set by State regulations.
The application form as per the respective states needs to be submitted along with the required documents and the prescribed fees.
The Registration certificate is required to be renewed periodically as mentioned in the state regulations.

What is the Mode of payment of the fee?

The payment of the prescribed fees for the shop and establishment registration can be done through offline as well as online mode.

What are the obligations of the employer in the implementation of the Act?

Registration under shop and Establishment Act provides certain obligations to employers. Some of the major obligations are:

All shops and Establishments in India shall operate between 7am to 10pm.
Shops need to be closed on weekly basics and on all government holidays.
They can avail weekly holidays for every seven days of work.
Work duration is limited to 8 hours a day and 48 hours a week, after which they need to be paid overtime.
A letter of appointment is to be provided to all employees
The minimum age for work is to be set at 14 years of age
Special provisions are to be provided to the women employees.
No women shall be made to work before 6 am and after 9pm.
Women employees to be given maternity benefit.
Leave entitlement for employees.
All such leave with wages can be of a minimum of 60 days.

In cases of non-payment of wages, deduction of wages, and non-payment of compensation an employee can approach the labour commissioner to seek redressal.

All Labour Department officials from the rank of Asst. Labour Officers have notified inspectors in their respective jurisdiction for the implementation of the Act.

How Factories Act differ from shops and establishment Acts?
Factories Act is often applicable to establishments where the manufacturing activity is done. Shops and Commercial Establishments Act on the other hand is applicable to establishments that do not qualify as a factory, mine, or plantations.
